PRINCIPLE: Everyone agrees that Shadowalk Covenants need amending to eliminate inconsistencies and ambiguities that often lead to different interpretations.  However, in amending the Covenants, care must be taken to preserve the unique rights of property owners that Shadowalk’s visionary developer, John Ringle, built into the document.

ISSUE: An ad hoc committee has recommended that the Board initiate a Covenant amendment requiring owners to do more maintenance and meet tougher appearance standards for road frontages and islands. The proposed amendment also would penalize owners for failure to comply. Penalties could include fines, property liens and foreclosures.

PRO: The reasons behind the committee’s proposal are unclear. Our community is well-kept under current rules. The committee didn’t explain why additional work and tougher standards are needed, or why owners should pay out-of-pocket for work that the Covenants have always required the Association to do and to pay for with dues revenues.

CON: There is no need for more maintenance and appearance rules, especially those that would remove time-tested owner property rights established by deed.  The proposed amendment would also enable the Association to shift its Covenant-assigned duties and operating costs to individual owners, imposing onerous financial burdens on those who can ill-afford or see no need to pay for excessive, above-norm maintenance.

FOR YOUR CONSIDERATION: The Board wisely tabled the committee’s proposal until Association members can be surveyed to determine how stringent frontage and island maintenance should be. No survey date has been set, but will likely happen in summer/fall 2017.
